Terms of Service

1. Acceptance of Terms
By accessing or using the Lumen platform (“Service”), operated by Foundation Nova Diem ABN 00 000 000 000 (“FND”, “we”, “us”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Who May Use the Service
The Service is available to authorised clinicians, researchers, and participants invited by an organisation that holds a valid Lumen licence. You must be at least 18 years old to hold an account.
3. Your Obligations
- Keep your account credentials confidential.
- Use the Service only for its intended purpose: psychological assessment and research.
- Do not attempt to access data belonging to other users or organisations.
- Comply with all applicable laws, including the Australian Privacy Act 1988 (Cth) and relevant state health records legislation.
4. Intellectual Property
All software, designs, reports, and documentation are owned by FND or its licensors. You receive a limited, non-transferable licence to use the Service during the term of your subscription. Assessment instruments and their scoring algorithms remain the intellectual property of their respective authors and are used under licence.
5. Data Ownership
Assessment data entered by or about participants remains the property of the participant and the inviting organisation. FND acts as a data processor under the Privacy Act 1988. We do not sell, share, or monetise your data.
6. Disclaimers
The Service is provided “as is” without warranties of any kind, except those implied by law that cannot be excluded. Lumen is a clinical decision-support tool; it does not replace professional judgement. All clinical decisions remain the responsibility of the treating clinician.
7. Limitation of Liability
To the maximum extent permitted by law, FND’s total liability for any claim arising from or related to the Service is limited to the amount you paid for the Service in the 12 months preceding the claim.
8. Changes to These Terms
We may update these Terms from time to time. Material changes will be notified via the Service at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
9. Governing Law
These Terms are governed by the laws of New South Wales, Australia. Any dispute is subject to the exclusive jurisdiction of the courts of New South Wales.
